Download of any software made available by us is subject to the following terms, to the extent permitted by law.
1. Definitions
- “Public Software” means any software package made available by VSC Media to the public, whether through the Apple App Store, Google Play Store, GitHub.com, private repositories, vscmedia.com, or any other website or platform operated by VSC Media.
- “Downloader” means any person or organisation downloading or causing technology to download the Public Software on their behalf.
2. Licence and Risk
Where Public Software is made available for free, or for a fee up to EUR 3.00 (or equivalent), the Public Software is provided “as is” without any warranty, to the fullest extent permitted by law, and the Downloader uses the software entirely at their own risk. Such use does not create a contractual relationship between VSC Media and the Downloader.
3. Pre-release Versions
Where Public Software is distributed for a fee but marked “alpha”, “beta”, “preview”, “nightly build”, or “test”, the Downloader accepts that VSC Media shall not be liable for unavailability, errors, or missing features.
If a feature is not expressly listed as part of a stable release, VSC Media accepts no liability for its absence or malfunction.
4. Limitation of Liability
In all cases, VSC Media’s liability in relation to Public Software shall be strictly limited to the purchase price paid for the download, to the extent permitted by law. This does not exclude liability for death or personal injury resulting from negligence where such exclusion is prohibited by law.
5. Intellectual Property
All intellectual property rights in Public Software remain with VSC Media or its licensors unless otherwise stated.
Where Public Software is released under an open-source licence (for example MIT, GPL, BSD, Apache, or similar), the Downloader’s relevant rights and obligations shall instead be governed by the terms of that licence.
Where VSC Media contributes code to a shared codebase governed by an open-source licence, the ownership of such contributions shall be retained by VSC Media unless the terms of that license require otherwise, in which case ownership shall be treated in accordance with the rules of that project and licence.
